Terms of Service

1. Acceptance of Terms

By accessing or using the Welthause platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

Welthause provides a cloud-based restaurant operations management platform that includes audit management, ticket tracking, financial reporting, workforce management, and asset tracking capabilities. The Service is provided on a subscription basis.

3. Account Registration

To use the Service, your organization must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription and Payment

  • Subscriptions are billed on a monthly or annual basis as selected during signup.
  • All fees are exclusive of applicable taxes.
  • We reserve the right to modify pricing with 30 days' notice.
  • Refunds are handled in accordance with applicable consumer protection laws.

5. Data Ownership

Your organization retains all ownership rights to the data you submit to the platform. We do not claim ownership of your content. We use your data solely to provide and improve the Service as described in our Privacy Policy.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with the proper functioning of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share login credentials with unauthorized individuals

7. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. Planned maintenance windows will be communicated in advance. We are not liable for downtime caused by circumstances beyond our reasonable control.

8. Limitation of Liability

To the maximum extent permitted by law, Welthause shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

9. Termination

Either party may terminate the subscription with 30 days' written notice. Upon termination, we will provide you with an export of your data within 30 days. After 90 days, your data will be permanently deleted unless retention is required by law.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Frankfurt am Main, Germany.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the platform. Continued use of the Service after changes constitutes acceptance of the updated terms.
